Enxora Pvt Ltd — Enxora Stream
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "Publisher," "you," or "your") and Enxora ("Enxora," "we," "us," or "our") governing your access to and use of the Enxora Stream platform, including the website, client dashboard, APIs, and the embedded Enxora Stream Player security layer (collectively, the "Service").
By creating an account, subscribing to a plan, or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you are entering into these Terms on behalf of a business, institution, or other entity, you represent and warrant that you have the authority to bind that entity. Enxora provides the security and identity-verification overlay; we do not provide video hosting, stream delivery, or cloud storage services. If you do not agree, you must not access the Service.
2.1. Service: The Enxora platform and all security sub-modules.
2.2. Content: Video material uploaded or protected by the Client.
2.3. Domains: Whitelisted Authorized Domains registered in the dashboard.
2.4. Viewers: Individuals accessing Content through the secure player.
2.5. Subscription: The plan tier including its specific usage allowances.
Enxora Stream is an in-browser video protection and player security infrastructure enabling Clients to protect video Content hosted on external platforms or servers. Enxora provides the security and identity-verification layer; the Service does not include video hosting, cloud storage, or stream delivery (CDN) services. Our suite includes:
3.1. Protection: Dynamic and IP-based Watermarking delivery.
3.2. Restriction: Domain Jail (Authorized Domain Lock) enforcement.
3.3. Monitoring: Proctor-AI Activity and Face Verification suites.
3.4. Visibility: Real-time Engagement and Security Analytics platforms.
Subject to compliance and payment, Enxora grants you a limited, non-exclusive, revocable license to use the Service during your subscription solely for the purpose of protecting your own Content displayed to your Viewers. Enxora provides the protective and identity-verification layer but does not manage viewer databases, host video files, or exercise editorial control over your Content.
You must be of legal age and have the capacity to enter into a binding contract. You are responsible for providing accurate registration information and maintaining the security of your account credentials. You must notify us immediately of any unauthorized access at contact@enxora.com.
6.1. Domains: Configure and maintain Authorized Domain settings with absolute accuracy.
6.2. Content Integrity: Ensure all protected Content does not infringe third-party intellectual property.
6.3. Data Sovereignty: Provide and maintain your own third-party Viewer databases required for identity watermarking; Enxora does not manage or host these records.
6.4. Regulatory Compliance: Comply with all local data protection and consumer laws applicable to your Viewers.
The Client is the exclusive Data Controller for their Viewers' Personal Data. You are solely responsible for lawful collection, obtaining necessary viewer consents (including for Proctor-AI/Webcam monitoring), and responding to data subject requests in accordance with our Privacy Policy.
You agree not to use the Service to:
8.1. Content: Distributing unlawful, infringing, or obscene material.
8.2. Tactics: Circumventing security (Watermarking, Domain Jail, Proctor-AI).
8.3. Compliance: Exceeding usage limits without upgrading your account.
8.4. Integrity: Interfering with infrastructure or other Client's use.
8.5. Reverse-Engineering: Deriving the source code of the Service.
8.6. Surveillance: Conducting unauthorized surveillance of individuals.
9.1. Pricing: Fees are set out on the website and are subject to change with notice.
9.2. Billing: Monthly plans are billed recursively; one-time license fees are payable in full upfront.
9.3. No Refunds: All fees are non-refundable including for early cancellation or account suspension.
9.4. Arrears: We reserve the right to suspend Service access immediately for failed or disputed payments.
While Enxora tools are high-standard deterrence measures, no security system is impenetrable. Enxora does not guarantee that content cannot be captured by determined actors (e.g., analog capture). Enxora shall not be liable for unauthorized redistribution of Content notwithstanding these features.
11.1. Ownership: Enxora owns all rights, title, and interest in the Service and its codebases.
11.2. Restrictions: You may not use Enxora's branding or logos without prior written authorization.
11.3. Content Rights: You retain all rights to the Content you protect using the Service.
Both parties agree to protect non-public "Confidential Information" (security protocols, business info) with reasonable care and use it solely for the purposes of these Terms, disclosing only to authorized employees or as required by law.
You agree to defend and hold harmless Enxora from any claims and damages arising from:
13.1. Assets: Claims that your Content infringes third-party rights.
13.2. Usage: Use of Proctor-AI in a manner inconsistent with these Terms.
13.3. Integrity: Privacy violations occurring directly on your own databases.
13.4. Violation: Any breach of these Terms or applicable local laws.
14.1. "As-Is" Service: THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES. We do not warrant that the Service will be error-free or that any security feature will prevent 100% of unauthorized access.
14.2. External Infrastructure: Enxora relies on third-party cloud providers, hosting, and internet infrastructure. We are not liable for Service unavailability caused by failures or maintenance of these third-party systems.
14.3. Continuity Efforts: In the event of a platform outage (including those caused by third parties), Enxora will use reasonable, good-faith efforts to restore Service access as quickly as possible.
14.4. Information Accuracy: We are not responsible for the accuracy of Viewer identity metadata supplied by your own external databases.
In no event shall Enxora be liable for indirect, incidental, or consequential damages (loss of profits, data). Our total aggregate liability is limited to the fees paid by you for the Service during the 12 months preceding the claim event.
Enxora may suspend or terminate access if we reasonably believe that:
16.1. Misconduct: Violation of these Terms or our Acceptable Use Policy.
16.2. Security: Usage that poses a risk to platform infrastructure.
16.3. Arrears: Failure to settle outstanding subscription fees.
16.4. Legal: Required actions to comply with regulatory orders.
Survival clauses include Intellectual Property Rights, Confidentiality, and Indemnification.
Parties agree to first attempt amicable, good-faith negotiation for any dispute. If unresolved, disputes may be pursued through courts within the governing jurisdiction.
18.1. Governing Law: These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of Sri Lanka.
18.2. Venue: You agree that the courts located in Kurunegala, Sri Lanka shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
Enxora is not liable for failure or delay caused by events beyond its reasonable control, including natural disasters, war, or internet/telecommunications failures.
If any provision is held to be invalid or unenforceable, it shall be modified to the minimum extent necessary or severed, and the remaining terms will continue in full force.
Enxora may assign its rights and obligations under these Terms without restriction. You may not assign your rights without our prior written consent.
These Terms, with the Privacy Policy, constitute the complete agreement between you and Enxora, superseding all prior communications or understandings.
We may modify these terms occasionally. Continued use of the platform constitutes your acceptance of the revised Terms. Material changes will be communicated via the dashboard.
